Terms and Conditions of Sale

 Welcome to www.MiN.com (the “Site”), operated by MiN NEW YORK, a US-based company (“we,” “us,” or “our”). These Terms and Conditions of Sale (“Terms”) govern all purchases of perfumes and products (“Products”) made through the Site by final consumers for personal use only, whether as individuals or businesses, within the United States. By placing an order on the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase Products.

1. Company Information

MiN NEW YORK is a US company. We create, design, and sell perfumes and related products. For inquiries or assistance, contact us at info@min.com.

2. Scope of Application

These Terms apply to all sales of Products offered on the Site to consumers located in the United States. The Site does not ship to P.O. Boxes, military bases, or general delivery addresses. For international orders, please visit our separate international site. All orders are subject to these Terms, which you accept by placing an order. Prices are in US dollars.

These Terms may be updated at any time, and the version in effect at the time of your order applies. These Terms, together with our separate Privacy Policy and Terms of Use, form the entire agreement between you and MiN NEW YORK.

3. Product Information

We strive to ensure the accuracy of Product information (e.g., names, descriptions, images, and compositions) on the Site. However, non-substantial errors may occur. Photographs and reproductions aim to represent Products faithfully, but minor variations may exist due to technical limitations.

Products are subject to availability. If a Product is unavailable after an order is placed, we will notify you promptly via email or phone and refund any payments related to the unavailable Product.

4. Ordering Products

4.1 General

Products are sold for personal use only. Purchase for resale or business purposes is prohibited, and we are not liable for any related losses. To order, you must be at least 18 years old, have legal capacity, and use a payment method accepted on the Site (specified at checkout).

You are responsible for providing accurate and up-to-date information. We are not liable for issues arising from inaccurate information. We may refuse orders if: (i) you have an unresolved payment dispute from a prior order, or (ii) the order violates these Terms.

4.2 Order Process

Step 1: Product Selection
Select Products, quantities, and options (e.g., size or format) and add them to your cart by clicking “Add to Cart.”

Step 2: Cart Verification
Review and modify your cart (add, remove, or adjust quantities). Prices and availability are displayed and subject to change until you proceed to checkout.

Step 3: Order Validation
Click “Proceed to Checkout” and:

• If you have an account, log in with your credentials.
• If ordering as a guest, provide your name, email, billing/shipping address, and phone number.
  Validate your delivery address, billing address, shipping method, and payment method.
  If applicable, enter a promotional code (e.g., for seasonal bounce-back offers or discounts) per Section 11.
  The total price, including taxes and shipping, will display. Click “Continue to Payment,” review your order, and click “Complete Order” after accepting these Terms by checking the provided box.

Step 4: Order Confirmation
You will receive an email confirming receipt of your order, including order details and any issues (e.g., availability or payment problems). The order is final upon receipt of a confirmation email without reservations.

Step 5: Order Acceptance
A binding sales contract is formed when we send an acceptance email without reservations, confirming the order details and these Terms.

Step 6: Dispatch Notification
You will receive an email when Products are shipped to your designated address.

5. Pricing

Prices are in US dollars, inclusive of applicable sales tax, and displayed at checkout once you enter your delivery address. Shipping costs, if any, are shown at order validation. Prices are subject to change, but the price at the time of your order applies.

If we discover a pricing or description error, we will notify you and offer the option to proceed at the correct price or cancel the order. We are not obligated to provide Products at an incorrect price.

6. Payment

We accept payments via Visa, Mastercard, American Express, PayPal, Apple Pay, and other methods specified at checkout. By submitting payment, you authorize us to charge the total amount, including taxes and shipping. Your card will be debited after verification. Orders with declined payments will be canceled. We retain ownership of Products until full payment is received.

7. Delivery

Products are delivered to the US address provided at checkout, using the selected shipping method. We are not responsible for errors in delivery information. Delivery is handled by our chosen carrier, with estimated delivery times provided at checkout and in the confirmation email. If delays occur, we will notify you and propose alternatives.

We are not liable for delays due to circumstances beyond our control (e.g., carrier issues, natural disasters, or strikes). Title and risk of loss transfer to you upon delivery to the carrier.

8. Returns and Refunds

You may return Products within 30 days of receipt (or, for multiple Products in one order, 30 days from receipt of the last Product) if unused, unopened, and in original packaging.

Return Process:

• Returns are not accepted in physical stores.
• Contact info@min.com to initiate a return and follow the provided instructions.
• Return Products via mail or courier at your expense, using recorded delivery or a trackable method.
• Products must be in perfect, unused condition with all original packaging, accessories, and delivery slip. Free samples, gift cards, and gift wrapping services are non-returnable.

We do not assume ownership of returned Products until received at our designated return address. Refunds will be issued to the original payment method within 14 days of receipt, subject to inspection. Shipping costs are non-refundable. Personalized, used, damaged, or unsealed Products (for hygiene reasons) and items marked “final sale” are not eligible for return or refund.

9. Promotional Offers

• Free Samples: Each purchase includes 2 complimentary samples, subject to availability, selected at checkout. Samples are non-returnable and non-exchangeable.
• Gift Cards: Gift cards are non-refundable and redeemable only on www.MiN.com. They cannot be redeemed for cash except where required by law.
• Gift Wrapping: Available as an optional service at checkout, with applicable fees. Non-refundable.
• Seasonal Bounce-Back Offers: Subject to specific terms (e.g., eligibility, redemption periods) provided at the time of the offer.
• Promotional Codes: Codes are non-transferable, have no cash value, and may have expiration dates or restrictions (e.g., first order only, minimum purchase). Only one code per order. Discounts are prorated across items; refunds for items purchased with a code will reflect the discounted value. Invalid or expired codes cannot be replaced.

10. Legal Warranties

Products are covered by a limited warranty under US law, ensuring they are free from defects in material and workmanship for one year from delivery. If a Product is defective, contact info@min.com to request repair, replacement, or a refund, at our discretion. This warranty does not cover damage from misuse, improper handling, or normal wear and tear. Your rights under applicable US consumer protection laws are not affected.

11. Intellectual Property

All content on the Site (e.g., text, images, logos, designs, and source code) is owned by or licensed to us and protected by US and international intellectual property laws. You may not use, reproduce, distribute, or modify any content without our prior written consent. These Terms do not grant you any rights to our intellectual property.

12. Personal Data

Personal data collected is limited to what is necessary to process your order and manage your account, as detailed in our separate Privacy Policy at www.MiN.com/privacy-policy-and-legal-statement/.

13. Limitation of Liability

To the fullest extent permitted by law, we are not liable for: (i) losses not caused by our breach, (ii) business losses (e.g., loss of profits, revenue, or goodwill), or (iii) indirect or consequential losses not reasonably foreseeable at the time of purchase. Our total liability is limited to the amount paid for the Products. We are not liable for delays or failures due to events beyond our control (e.g., strikes, natural disasters). If such an event persists for over 30 days, either party may cancel affected orders, and we will refund payments promptly. This does not affect your statutory rights.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any disputes will be resolved exclusively in the state or federal courts in Delaware. You agree to submit to their jurisdiction. This does not affect your rights under mandatory US consumer protection laws.

15. Miscellaneous

If any provision of these Terms is found invalid, the remaining provisions remain in effect. We may suspend or terminate your access to the Site for violating these Terms. For questions, contact us at info@min.com.
